§1 Scope

§2 Service
The service provided by Linh Le, a certified nutritionist and consultant for holistic health aims at improving the client’s diet, living conditions, relaxation, prevention, and holistic health. The information provided is purely informative and serves to impart knowledge and must under no circumstances be viewed as a substitute for professional advice or treatment by trained and qualified doctors or alternative practitioners. It does not contain any recommendations regarding specific diagnostic or therapeutic procedures. The content must not be understood as medical instructions or as a request for self-treatment or as a basis for self-diagnosis and self- medication, nor can they replace individual care by a doctor or alternative practitioner. The implementation of the recommendations discussed should always be discussed with a qualified therapist. It is recommended to have food intolerances checked and to have blood values taken regularly to determine potential nutrient deficiencies. Following the recommendations is at the client’s own risk and responsibility. Everything that the client does, receives, experiences, and will give happens voluntarily, at her own risk, and on her own responsibility.
§3 Data protection and confidentiality
The client expressly consents to electronic data processing within the framework of the following regulations. Client data is treated with absolute confidentiality. The data communicated by the client is used exclusively for the needs-based creation of offers and of NIARIA’s own market research.
§4 Implementation of nutritional advice
The subject of the order is the provision of a service, e.g. nutritional advice, and not the achievement of certain physical success.
§5 Conditions of participation
TIf the client has health problems or existing illnesses, she must consult a doctor or alternative practitioner before the first session. A change in diet can have an impact on the client’s health, e.g. the dose of medication needs to be changed.
§6 Registration and payment conditions
By submitting the registration data to the nutritionist Linh Le and agreeing to the terms and conditions listed here, regardless of whether in electronic or postal form, the client enters into a binding contract for the advisory service ordered. The due sum can be paid in one payment.
§7 Limitation of Liability and Warranty
Liability of the nutritionist for direct or indirect consequential damage caused by the coaching service is excluded. The coaching service is provided to the best of the nutritionist’s knowledge and belief, based on the latest state of science and technology, but no guarantee can be given for the success of the services. The coaching is help for self-help, the success of the coaching is therefore beyond the nutritionist's sphere of influence and depends largely on the cooperation of the client to be advised. Nutritional advice does not replace medical advice or medical therapy.
§8 Protection of property
The information materials, reports, analyses, and other documents prepared in the context of the coaching are exclusively personal and cannot be used by third parties. The client receives the exclusive and unrestricted non-transferable right of use to all documents and undertakes to use them exclusively for her own purposes and not to pass them on to third parties.
§9 Final provision
Changes and additions to this contract must be made in writing to be effective. Verbal collateral agreements do not exist.
§10 Severability clause
Should one of these regulations be ineffective, the effectiveness of the remaining regulations is not affected. The ineffective clause will be replaced by a regulation that the contracting parties would have agreed to according to the economic objectives and the purpose of these general terms and conditions if they had known the loopholes.
